What is a Child Arrangements Order?
A Child Arrangements Order is generally a last resort when all other options and avenues for reaching an agreement with your ex-partner in relation to your children have been exhausted.
It may be that communication between you and your ex-partner has broken down to such an extent that it is just not possible to reach an agreement between yourselves. It may be that, whilst the dialogue is still open between you and your ex-partner, you just cannot agree on the best arrangements for your children.
What can be included in a Child Arrangements Order?
Child Arrangements Orders can be used to define a number of matters relating to your child including: –
- Which parent your child is to live with;
- How frequently your child is to spend with the non-resident parent;
- The type of direct contact your child is to have with the non-resident parent, for example, whether it is just for a couple of hours or overnight and whether it is to be supervised or unsupervised;
- Whether your child is to have indirect contact with the non-resident parent, for example, by way of phone calls, Facetime, letters etc;
- Arrangements for how the school holidays will be divided between the two parents and provision for any change to term time contact; and
- Arrangements for taking your child on holiday either in the UK or abroad, for example, giving the other parent a defined period of notice if you wish to take your child away and providing them with details of the trip.
